A heated dispute over rooftop planters in London's exclusive Notting Hill has sparked a fierce debate among residents and officials. The story begins with a wealthy French couple, Nicolas and Stephanie Joseph, who found themselves at the center of a long-standing feud after adding colorful planters to their £2.5 million home.
The couple's plans to enhance their roof terrace reignited a years-long conflict that originated with the previous owner, Lady Samantha Kane, a controversial trans barrister. The Josephs' decision to increase the height of the rear wall and install aluminum plant boxes around the perimeter sparked an acrimonious campaign among their well-heeled neighbors.
"It's been a nightmare," one neighbor shared anonymously. "The whole thing has been terrible and appalling. It started with Samantha Kane, who was Charles Kane at the time. Charles turned the flat roof into a terrace, and people started gathering there, looking straight into my daughter's bedroom."
The dispute escalated, leading to an altercation on the street and complaints about the towering containers creating a "barricade" and blocking light to neighboring houses. Officials from Kensington and Chelsea Council agreed, launching enforcement action last August, claiming the planters were installed without planning permission.
The Josephs argued that the containers, filled with a mix of real and artificial blooms, improved privacy for their neighbors and caused no harm. They blamed a "small number of hostile neighbors" for influencing the council's decision to pursue enforcement action.
The situation took an interesting turn when it was revealed that Lady Kane, thought to be the only person in Britain to have changed gender three times, had transformed the flat roof into a terrace without planning permission. She later sold the property to the Josephs for £2.2 million in 2022 and now styles herself as Lady Samantha Carbisdale after purchasing a £5 million Scottish castle.
The debate raged on, with some residents condemning the council's "harsh" enforcement action and calling for more green spaces on the street. Others, however, backed the council's decision, citing the need to preserve the character of the historic neighborhood, once part of a notorious slum known as "The Potteries and the Piggeries."
In a detailed ruling, the planning inspectorate found that while the planters did not harm the area's character or appearance and did not cause a "harmful loss of privacy" to neighboring residents, they did result in a "substantial increase in the height of solid expanse of built form."
Planning inspector Jason Whitfield concluded that the "stark appearance, black coloring, and solid design" of the planters caused harm to neighbors' outlook. The Josephs now have three months to remove the structures, a decision they believe is "disproportionate and excessive" given the presence of multiple other roof terraces along the same street.
"We never imagined that having a lawful roof terrace would mean so much trouble," the couple said. "Our roof terrace is legal, and we worked constructively with the council throughout the process."
